1. Acceptance of Terms

By accessing, browsing, or using the MindAtlas platform (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), as well as our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and MIND ATLAS INTEGRATION PTY LTD (ACN 695 009 511) ("MindAtlas", "we", "us", or "our").

MindAtlas is an online platform that provides psychedelic integration support through evidence-based tools, reflective prompts, community resources, and access to professional facilitators. Our services include, but are not limited to:

  • Integration journaling and reflection tools
  • Guided challenges and structured programs
  • Diagnostic and self-assessment tools (e.g., Tuesday Test, Values Compass, Mindful Pulse)
  • Session preparation resources
  • Access to trained integration facilitators for one-on-one sessions and peer circles
  • Educational content and curated resources

MindAtlas operates on a freemium model with tiered subscription options (Free, Explorer, Navigator, Professional) that unlock progressive access to features and services.

4. Medical Disclaimer

IMPORTANT: PLEASE READ CAREFULLY

MindAtlas is NOT a medical service, psychotherapy practice, crisis intervention service, or substitute for professional clinical care. Nothing on this Platform constitutes medical advice, diagnosis, or treatment.

Our services are designed to support integration of psychedelic experiences alongside, not instead of, professional medical and psychological care. MindAtlas facilitators are not licensed medical professionals, psychologists, or psychiatrists unless explicitly stated in their individual profiles.

If you are experiencing a mental health crisis, suicidal thoughts, or medical emergency, do not rely on this Platform. Immediately contact emergency services (000 in Australia, 999 in the UK) or go to your nearest emergency department.

By using this Platform, you acknowledge that you are responsible for consulting with qualified healthcare professionals regarding any medical, psychological, or psychiatric concerns. MindAtlas does not provide, and cannot substitute for, professional medical advice.

5. User Accounts and Registration

To access certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

You must be at least 18 years of age to create an account and use the Platform. By registering, you represent and warrant that you meet this age requirement.

6. Subscription and Payment Terms

6.1 Subscription Tiers

MindAtlas offers multiple subscription tiers. Details of features and pricing are available on our Pricing page. Prices are displayed in GBP (£) and are subject to change with reasonable notice.

6.2 Payment Processing

All payments are processed securely through Stripe. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge all fees incurred.

6.3 Recurring Billing

Subscriptions automatically renew on a monthly or annual basis (depending on your selected plan) unless cancelled before the renewal date. You will be charged at the beginning of each billing cycle.

6.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing cycle. We do not provide refunds for partial subscription periods, except where required by law or at our sole discretion.

6.5 Facilitator Payments

Payments for one-on-one sessions and peer circles are processed separately and are non-refundable except in cases of facilitator cancellation or as outlined in our Refund Policy.

7. User Conduct and Responsibilities

You agree not to use the Platform to:

  • Violate any applicable local, national, or international law or regulation
  • Infringe upon the rights of others, including intellectual property rights
  • Transmit harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the integrity or performance of the Platform
  • Attempt to gain unauthorized access to any part of the Platform, other user accounts, or computer systems
  • Distribute viruses, malware, or other harmful code
  • Scrape, harvest, or collect information about other users without their consent
  • Use the Platform for commercial purposes without our explicit written permission

We reserve the right to investigate and take appropriate legal action against anyone who violates these Terms, including removing content, suspending or terminating accounts, and reporting to law enforcement authorities.

8. Data Protection and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms part of these Terms. Key points include:

  • All user data is encrypted and stored securely using industry-standard protocols
  • Your journal entries, reflections, and assessment results are private by default
  • You control what information you share with facilitators through explicit opt-in mechanisms
  • We comply with applicable data protection laws, including GDPR and Australian Privacy Principles
  • You have the right to access, correct, export, or delete your personal data

9. Intellectual Property

9.1 Our Content

All content, features, and functionality on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the design, selection, and arrangement thereof, are owned by MindAtlas, its licensors, or other content providers and are protected by Australian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

9.2 Your Content

You retain ownership of all content you create on the Platform, including journal entries, reflections, and responses. By submitting content, you grant MindAtlas a limited, non-exclusive, royalty-free license to store, process, and display your content solely for the purpose of providing our services to you.

We will never sell your personal content or use it for marketing purposes without your explicit consent.

9.3 Permitted Use

You may access and use the Platform for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of our content without our prior written permission.

10. Facilitator-Specific Terms

10.1 Facilitator Registration

Facilitators must complete a verification process and provide evidence of relevant training, qualifications, and professional indemnity insurance. MindAtlas reserves the right to approve or reject facilitator applications at our sole discretion.

10.2 Professional Conduct

Facilitators must adhere to professional ethical standards, maintain appropriate boundaries with clients, and comply with all applicable laws and regulations governing their practice.

10.3 Payment and Fees

MindAtlas processes payments on behalf of facilitators and retains a platform fee for each session. Payment terms and fee structures are detailed in separate Facilitator Agreements.

10.4 Client Relationship

Facilitators are independent contractors, not employees of MindAtlas. The therapeutic or support relationship exists solely between the facilitator and client. MindAtlas is not responsible for the quality, content, or outcomes of facilitator services.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MINDATLAS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, REVENUE, DATA, OR USE
  • ANY CONTENT OR CONDUCT OF ANY THIRD PARTY ON THE PLATFORM
  • ANY CONTENT OBTAINED FROM THE PLATFORM
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO MINDATLAS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED POUNDS (£100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless MindAtlas, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable legal fees) arising from:

  • Your use or misuse of the Platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your content or conduct on the Platform

13. Termination and Account Closure

13.1 Termination by You

You may terminate your account at any time by using the account deletion feature in your settings or by contacting us at mindatlasintegration@gmail.com. Upon account deletion:

  • Your profile, journal entries, and personal data will be permanently deleted
  • Active subscriptions will be cancelled immediately
  • You will receive a confirmation email
  • Some anonymized data may be retained for legal compliance and analytics purposes

13.2 Termination by MindAtlas

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for conduct that we believe:

  • Violates these Terms or our policies
  • Harms MindAtlas, its users, or third parties
  • Exposes MindAtlas to legal liability
  • Is fraudulent, abusive, or illegal

13.3 Effect of Termination

Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.

Delete Your Account

If you wish to permanently delete your MindAtlas account and all associated data, you can do so using the button below. This action cannot be undone.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

  • Updating the "Last updated" date at the top of this page
  • Sending an email to your registered email address
  • Displaying a prominent notice on the Platform

Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Platform and may terminate your account.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Australia and the state of New South Wales, without regard to conflict of law principles. For users in the United Kingdom, nothing in these Terms affects your statutory rights under UK consumer protection laws.

15.2 Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Platform, you agree to first contact us at mindatlasintegration@gmail.com to attempt to resolve the matter informally.

If informal resolution is unsuccessful within 30 days, either party may initiate binding arbitration or litigation in the appropriate courts of New South Wales, Australia. Each party irrevocably submits to the exclusive jurisdiction of such courts.

16. Complaints Procedure

If you have a complaint about the Platform, our services, or the conduct of a facilitator, we want to hear from you. We take all complaints seriously and are committed to resolving issues fairly and promptly.

16.1 How to Submit a Complaint

You may submit a complaint using the form below, or by emailing us directly at mindatlasintegration@gmail.com. You can choose to submit your complaint anonymously or provide your contact details.

16.2 Our Complaints Process

  1. Acknowledgment: We will acknowledge receipt of your complaint within 2 business days
  2. Investigation: We will investigate your complaint thoroughly and impartially
  3. Response: We will provide a substantive response within 5 business days
  4. Escalation: If you are not satisfied with our response, you may request escalation to senior management
